These Terms & Conditions (“Terms”) govern your access to and use of our website and your purchase of our products. By browsing our website, placing an order, or submitting an inquiry, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Products & Availability
We handcraft traditional food products, including our signature Khajuri, seasonal specials, and festival gift packs, in small batches. As our products are freshly prepared, availability may vary by season, demand, and ingredient supply. We reserve the right to modify, limit, or discontinue any product at any time without prior notice.
Orders & Pricing
All prices are listed in Nepalese Rupees (NPR) and are inclusive of applicable charges unless stated otherwise. Prices are subject to change without notice, particularly in response to ingredient costs and seasonal factors. The price applicable to your order is the price confirmed at the time your order is accepted. We make every effort to display accurate product information, but errors may occasionally occur; where we identify an error, we reserve the right to correct it and to cancel affected orders.
Payment
Payment must be completed through the methods we make available, which may include cash on delivery, bank transfer, or digital payment options. For bulk, wholesale, or event orders, we may require advance payment or a deposit to confirm your order. Orders are considered confirmed only once payment or the agreed deposit is received, unless otherwise arranged in writing.
Delivery & Pickup
We currently deliver across Kathmandu and select cities in Nepal, with pickup available from our kitchen. Delivery timelines are estimates and may be affected by location, weather, festival demand, and other factors beyond our control. Please ensure the delivery address and contact details you provide are accurate, as we are not responsible for delays or failed deliveries caused by incorrect information.
Cancellations & Refunds
Because our products are perishable food items, cancellations must be requested before preparation or dispatch begins. Once an order has been prepared or dispatched, it cannot be cancelled or refunded. If your order arrives damaged, incorrect, or of unsatisfactory quality, please contact us within 24 hours of delivery with supporting details or photographs. Where a valid issue is confirmed, we will offer a replacement or an appropriate resolution at our discretion. Refunds, where applicable, are processed through the original payment method.
Intellectual Property
All content on this website — including our brand name, logo, product names, recipes, imagery, text, and design — is the property of Mithila Jalpaan and PATHAK & SON'S, or is used with permission, and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any of our content for commercial purposes without our prior written consent.
Limitation of Liability
Our products are prepared with care using quality ingredients. If you have food allergies or dietary restrictions, please review product information and contact us before ordering. To the fullest extent permitted by law, Mithila Jalpaan and PATHAK & SON'S shall not be liable for any indirect, incidental, or consequential loss arising from the use of our website or products. Our total liability in connection with any order shall not exceed the amount paid for that order.

These Terms are governed by and construed in accordance with the laws of Nepal. Any disputes arising in connection with these Terms or your use of our services shall be subject to the jurisdiction of the competent courts of Nepal.
